Terms of Service

1. Agreement

These Terms of Service (“Terms”) form an agreement between you and Advisor Toolkit LLC (“CashFlowAlign,” “we,” or “us”) governing your access to and use of the CashFlowAlign website and app (the “Service”), including cashflowalign.net and related pages. By using the Service, you agree to these Terms and to our Privacy Policy.

2. The Service

CashFlowAlign is software that helps households organize income, fixed commitments, non-monthly expenses, and weekly spending, and project operating-checking cash flow. You may use the Service in your browser with local storage and, optionally, create an account to sync your plan to the cloud. We may update, improve, or change features of the Service at any time.

3. Eligibility and your responsibilities

• You must be at least 18 years old and able to enter into a binding contract.
• You are responsible for the accuracy of information you enter and for decisions you make based on the Service.
• You are responsible for protecting access to any device where the Service stores data locally.
• If you create an account, you are responsible for keeping your credentials secure and for activity under your account. Use password-reset tools promptly if you believe your account was compromised.

4. Subscriptions and billing

Some features may require a paid subscription in the future. Pricing and plan terms will be shown in the Service before you subscribe. If billing is introduced:

• Subscriptions renew on a recurring basis until cancelled, unless otherwise stated.
• You can cancel according to the cancellation controls shown in the Service; cancellation typically takes effect at the end of the current billing period.
• Payments may be processed by a third-party payment provider. By providing payment information, you authorize charges for fees due.
• Except where required by law, fees are non-refundable.
• We may change pricing on renewal with reasonable advance notice.

Until paid plans are offered, access may be free or otherwise described on the site.

5. Your data

You retain ownership of the information you enter into the Service. You grant us a limited license to host, process, and display that information solely as needed to provide the Service to you—including running the app in your browser and, if you sign in, storing and syncing your plan and account profile in our cloud infrastructure.

You represent that you have the right to enter the information you submit and that your use of the Service will not violate any law or third-party right.

6. Acceptable use

You will not:

• Reverse engineer, decompile, or attempt to access the source code of the Service except as permitted by law.
• Use the Service to send spam, malware, or unlawful content.
• Interfere with the integrity, security, or performance of the Service.
• Use the Service to build a competing product, or scrape or harvest data from the Service in bulk.
• Share account credentials with unauthorized people or attempt to access another user’s account or data.

7. Intellectual property

Advisor Toolkit LLC and its licensors retain all rights, title, and interest in the Service, including the software, design, content, and trademarks (including CashFlowAlign™). These Terms do not transfer ownership of the Service to you.

8. No financial, legal, or tax advice

CashFlowAlign is a software planning tool. Outputs such as recommended weekly amounts, timelines, averages, and related calculations are for educational and planning purposes only. They are not individualized financial, investment, legal, tax, or other professional advice from CashFlowAlign or Advisor Toolkit LLC. You are solely responsible for confirming entries and for decisions you make. Consult qualified professionals before making financial decisions.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT CALCULATIONS WILL BE COMPLETE OR ACCURATE FOR YOUR SITUATION.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ADVISOR TOOLKIT LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

11. Indemnification

You will indemnify and hold Advisor Toolkit LLC and its affiliates harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your data, your violation of these Terms, or your violation of any law or third-party right.

12. Suspension and termination

We may suspend or terminate access to the Service if you breach these Terms, if required by law, or to protect the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, indemnification, and governing law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Texas, and you and we consent to the personal jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page and, when we have an email relationship with you (for example, because you created an account), notify you by email or through the Service before the changes take effect where required. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
